1. Agreement to these terms

These Terms govern your access to and use of the TryEnglish.ai website, contact forms, software testing services, QA reports, and related support. By using the website or engaging TryEnglish.ai for services, you agree to these Terms.

If you use TryEnglish.ai on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Services

TryEnglish.ai provides practical software testing, QA observations, bug reports, release-readiness notes, and related recommendations for websites, applications, e-commerce experiences, and software products. The exact services, timing, deliverables, and scope may vary by project or support arrangement.

Our work is intended to help teams identify issues and make informed decisions. It does not guarantee that every defect, compatibility issue, security issue, accessibility issue, performance issue, or edge case will be found.

3. Scope, access, and customer responsibilities

You are responsible for providing accurate instructions, scope, URLs, test accounts, staging access, browser or device requirements, deadlines, and any other materials needed for the agreed work. You are responsible for ensuring that you have the right to provide those materials and authorize testing.

You should not send production passwords, regulated data, payment card data, health data, or other sensitive information through public forms. If credentials or private environments are needed, we can coordinate access separately.

4. Pricing, billing, and payment

TryEnglish.ai does not maintain fixed public pricing for all work. Pricing is project-based and depends on the amount and type of work, scope, schedule, complexity, browser and device coverage, access needs, reporting format, retesting needs, and any ongoing support arrangement.

Any fees, payment timing, cancellation terms, included work, and renewal details will be stated in a proposal, quote, invoice, order form, statement of work, email confirmation, or other written agreement. Unless otherwise stated in writing or required by law, fees for completed work are non-refundable.

Taxes, payment processor fees, bank fees, currency conversion fees, or similar charges may apply depending on payment method and location.

5. Customer materials and reports

You retain any rights you have in materials you provide to TryEnglish.ai. You grant TryEnglish.ai permission to host, store, review, reproduce, transmit, and process those materials as needed to provide services, prepare reports, communicate with your team, keep records, and operate the business.

QA reports, screenshots, notes, and recommendations are provided for your internal review and business use. You are responsible for deciding which issues to fix, how to prioritize them, and whether a product is ready to ship.

6. Acceptable use

You agree not to use TryEnglish.ai to test systems you do not own or have permission to test, submit unlawful or harmful materials, interfere with the website or services, bypass access controls, misrepresent results, or ask us to perform activity that would violate law or third-party rights.

7. Third-party services

TryEnglish.ai may rely on third-party services for hosting, email, storage, documents, analytics, payments, communications, testing tools, and related operations. Those services may be subject to their own terms and policies. We are not responsible for third-party services we do not control.

8. Feedback

If you provide feedback, suggestions, ideas, or requests, you allow TryEnglish.ai to use them without restriction or compensation.

9. Suspension and termination

We may decline, suspend, or stop services if we reasonably believe the work creates legal, security, abuse, payment, operational, or safety risk, or if you breach these Terms or another agreement. You may stop using the website at any time.

10. Disclaimers

TRYENGLISH.AI SERVICES, REPORTS, SNAPSHOTS, AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" UNLESS A SEPARATE WRITTEN AGREEMENT SAYS OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TryEnglish.ai does not provide legal advice, formal security audits, penetration testing, compliance certification, or a guarantee of defect-free software unless expressly agreed in writing.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYENGLISH.AI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE WEBSITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYENGLISH.AI'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE WEBSITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO TRYENGLISH.AI FOR THE RELEVANT SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless TryEnglish.ai from claims, liabilities, damages, losses, and expenses arising from your materials, your products, your use of reports, your instructions, your violation of these Terms, or your violation of law or third-party rights.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the date above. Your continued use of the website or services after changes become effective means you accept the updated Terms.
